The AI Act is the first European regulation governing the use of artificial intelligence. Enforced since August 1, 2024, it establishes a legal framework to ensure that AI systems used within the European Union uphold fundamental rights, safety, and ethical standards. The regulation adopts a risk-based approach, classifying AI systems into four categories: unacceptable risk, high risk, limited risk, and minimal risk.
The obligations vary according to the level of risk of the AI system:
Unacceptable risk : total prohibition (e.g. social scoring, cognitive manipulation).
High risk : strict requirements regarding risk management, transparency, data quality, technical documentation, human oversight, and cybersecurity.
Limited risk : Transparency obligations, including informing users that they are interacting with an AI.
Minimal risk : No specific obligations, but encouragement to follow voluntary codes of conduct.
No, the AI Act and the GDPR are complementary. The GDPR focuses on the protection of personal data, while the AI Act regulates the use of AI systems. Both regulations can apply simultaneously, especially when AI systems process personal data.
The AI Act entered into force on August 1, 2024, with a phased implementation:
February 2025 : Implementation of bans on systems with unacceptable risk.
